ELIGIBLE ENTRANTS

Entry to the Promotion is open to Australian residents aged 18 years or over who comply with these Terms and Conditions, excluding residents of South Australia and the Australian Capital Territory, who are not eligible to enter or win this Promotion due to regulatory restrictions.

Employees, directors, management, officers of the Promoter, its associated companies or agencies, and their immediate families are ineligible to enter.

Entry may be obtained via purchase of a subscription or package, or via the free entry method outlined in these Terms.

Entry is subject to all applicable laws and regulations and is void where prohibited.

ENTRY REQUIREMENTS & INSTRUCTIONS

To enter the Promotion, you must:

* Follow the prompts to the Promotion’s entry page

* Input all requested details (including package details, your full name, email, and phone number)

ENTRY CONDITIONS

Each package grants a specified number of entries as outlined on the Website.

Each individual entry has an equal chance of being selected. Entrants may receive multiple entries depending on the package selected or method of entry.

There is no limit on the number of entries per person, subject to these Terms and Conditions.

DRAW DATE & METHOD

There will be one winner determined for each Prize in this Promotion.

The Prize draw will take place at a time and place to be determined by the Promoter via a government-approved digital draw system named Randomdraws.

The draw is conducted independently and without human interference.

WINNER NOTIFICATION

The Winner will be notified by phone and email within 24 hours of the draw and published on the Promoter’s website for a minimum of 28 days.

PRIZE CLAIM

Prize Claim Date: From time of draw until 8th August 2026.

If a Prize is not claimed by this date, a redraw will occur.

GENERAL TERMS & CONDITIONS

1. INTRODUCTION

1.1 These Terms & Conditions are to be read in conjunction with the Promotion Details above.

1.2 By participating in the Promotion, you agree to be bound by these Terms & Conditions.

1.3 Where applicable, Permit Numbers apply.

1.4 All decisions made by the Promoter are final, subject to applicable laws.

2. ENTRY

2.1 All entries must comply with these Terms & Conditions.

2.2 Entries must be submitted during the Promotional Period.

2.3 Entries are deemed received when recorded by the Promoter.

2.4 Entrants must be eligible; the Promoter may disqualify ineligible entrants.

2.5 Entrants are responsible for their own entry costs.

2.6 The Promoter may use entries for promotional purposes.

3. PRODUCT AND PROMOTION STRUCTURE

All purchases relate to access to MWMX products, including the motocross coaching app and training programs.

Entries into promotions are provided as an additional benefit.

4. MAJOR PRIZE WINNER LIMITATION

To promote fairness across participants:

(a) An individual may win a maximum of three (3) Major Prizes (being any prize valued at AUD $10,000 or more) across all MWMX promotions.

(b) Any entrant who has already won three (3) Major Prizes will be ineligible to be awarded any further Major Prizes.

(c) In addition, any entrant who has won a Major Prize will be ineligible to be awarded another Major Prize for a period of one (1) month from the date of their win.

(d) Entrants who are ineligible under this clause may still enter future promotions and may win non-major prizes.

(e) If an ineligible entrant is selected as a winner of a Major Prize, that entrant will be deemed ineligible and the prize will be re-awarded via a redraw in accordance with these Terms and Conditions.

5. DRAW & RESERVE WINNERS

The draw will be conducted randomly.

If a winner is ineligible, cannot be contacted, or forfeits the Prize, the Prize will be awarded to a reserve winner or via redraw.

6. PARTICIPANT CONDUCT

Entrants must not:

* Tamper with the Promotion

* Use false identities

* Engage in unfair conduct

The Promoter may disqualify entrants for breach.

7. PERSONAL INFORMATION

Personal information is collected to conduct the Promotion and may be used for marketing purposes.

8. LIABILITY

To the fullest extent permitted by law, the Promoter is not liable for loss or damage arising from participation.

Motocross is a high-risk activity and participation is at your own risk.

These Terms are governed by the laws of Victoria, Australia.

Definitions

Unless the context indicates otherwise:

“Seller” means MWMX (ACN 687 296 215)

“Customer” means the individual(s) or entity ordering Products from the Seller, including anyone acting on the Customer’s behalf with their authority.

“Price” means the amount payable by the Customer to the Seller for the Products.

“Products” means goods or services provided by the Seller, including the MWMX Motocross Coaching App and training programs, as described on the Website, invoices, quotations, or other forms issued by the Seller.

“Terms and Conditions” means the terms of sale outlined in this document.

Acceptance of Terms

By ordering Products or accepting delivery of Products from the Seller, the Customer agrees to be bound by these Terms & Conditions.

Entry Package Inclusions

To participate in the Promotion, you must purchase a package, granting access to MWMX Products, including the MWMX Motocross Coaching App and/or training programs. The packages include:

ENTRY: MWMX training program

BRONZE: 5 days app access, training program access

SILVER: 15 days app access, training program access

GOLD: 30 days app access, training program access

PLATINUM: 50 days app access, training program access

DIAMOND: 100 days app access, training program access

Payment

All prices on https://mwmx.com.au are in Australian dollars, include GST where applicable, and are subject to change without notice. The Seller may adjust prices, product offerings, availability, policies, or terms at its discretion.

Accepted payment methods include Credit/Debit Card (Visa and MasterCard only) and PayPal, processed securely through third-party providers: PayPal for card payments and PayPal for PayPal transactions.

Subscriptions are monthly auto-renewing. To cancel an auto-renewing subscription, email info@mwmx.com.au at least 7 days before the next billing cycle.

Returns/Refunds

You may request a refund by emailing info@mwmx.com.au within 14 days of purchase, including your order number and reason for cancellation. Refunds will be issued for services that are faulty, not as described, or unfit for purpose, as required by Australian Consumer Law. Discretionary refunds for unused app access may be approved at the Seller’s discretion.

Intellectual Property

All content, information, graphics, and design on the Website and MWMX Motocross Coaching App are owned by the Seller and may not be used or reproduced without permission.

By submitting content (e.g., feedback or comments) to the Website or App, you grant the Seller a non-exclusive, royalty-free license to use, reproduce, and display such content for business purposes. You warrant that your content does not infringe third-party rights (e.g., copyright or trademarks).

Limitation of Liability

The Customer acknowledges that they purchase Products based on their own judgement and expertise.

The MWMX Motocross Coaching App provides general training guidance. Motocross is a high-risk sport, and you participate at your own risk. The Seller is not liable for injuries or damages resulting from following app advice. Consult a qualified coach or medical professional before undertaking training.

Any advice or recommendations provided by the Seller are given in good faith and believed to be reliable, but the Seller is not liable for issues arising from improper use or failure to follow instructions.

As required by law, the Seller’s liability is limited to personal injury or property damage caused by its negligence. If the Seller breaches these Terms, the Customer’s remedies are limited to damages not exceeding the Price of the Products.

The Seller is not liable for indirect losses, including lost profits, incurred by the Customer.

Severance

If any provision of these Terms & Conditions is found to be invalid, void, illegal, or unenforceable, the remaining provisions remain valid and enforceable. These Terms do not override mandatory provisions of Australian Consumer Law or other applicable laws.

Jurisdiction

These Terms & Conditions are governed by the laws of Victoria. The Seller and Customer submit to the exclusive jurisdiction of Victorian courts.

Waiver

The Seller’s failure to enforce any provision does not constitute a waiver of that provision or affect its right to enforce it later.

Inconsistency

If these Terms & Conditions conflict with a written quotation, work authorisation, or other form provided by the Seller, the terms of the quotation, work authorisation, or form take precedence.

Whole Agreement

These Terms & Conditions, along with any written quotation, work authorisation, or other form from the Seller, constitute the entire agreement between the Seller and the Customer. Verbal discussions or statements not confirmed in writing by the Seller have no legal effect.

Amendment

These Terms & Conditions replace all prior terms of trade issued by the Seller.

The Seller may revise these Terms & Conditions at any time. Changes take effect when the Seller notifies the Customer.

The Customer’s acceptance of changes is shown by placing further Product orders after receiving notice, without requiring additional formal acceptance.
