1. PROMOTION DETAILS

The Promotion is a game of chance. No skill is required to enter or win.

2. PRIZES

2.1 Major Prize

One eligible winner will receive their choice of:

Option A – 2026 KTM500

Motorcycle prize value: $19,690.00 AUD

Option B – Cash

$15,000 AUD cash

The Major Prize winner may select either Option A or Option B. The winner is not entitled to receive both.

2.2 Additional Prizes

Second Prize: $100 AUD cash

Third Prize: $50 AUD cash

Prize values are accurate or reasonable estimates as at the commencement of the Promotion and may fluctuate.

Unless expressly stated otherwise, registration, licensing, insurance, maintenance and ongoing ownership or operating costs associated with a motorcycle after transfer are the responsibility of the winner.

3. PERMITS, AUTHORITIES AND JURISDICTIONS

NSW Trade Promotion Authority: TP/02960

The Promotion will only be conducted in jurisdictions in which MWMX is legally entitled to conduct it and will be subject to all applicable laws, permits, authorities, approvals and regulatory conditions.

Where a mandatory legislative requirement or applicable permit, authority or regulatory condition is inconsistent with these Terms, that requirement will prevail to the extent of the inconsistency.

MWMX may exclude a jurisdiction where necessary to comply with applicable laws or regulatory requirements.

4. ELIGIBILITY

Entry is open to Australian residents aged 18 years or older who satisfy these Terms.

Residents of South Australia and the Australian Capital Territory are not eligible to win the Major Prize in this Promotion.

Eligible residents of all other Australian States and Territories may participate, subject to applicable laws and these Terms.

Employees, directors, officers and management of MWMX, persons directly involved in conducting or determining the outcome of the Promotion, associated agencies directly involved in the Promotion, and their immediate families are ineligible to enter.

MWMX may require reasonable evidence of an entrant's:

identity;
age;
residential address;
eligibility;
qualifying purchase or activity; and
compliance with these Terms.

An entrant who cannot reasonably establish eligibility may be disqualified, subject to applicable law.

5. PURPOSE AND STRUCTURE OF THE PROMOTION

MWMX operates a motorcycle-focused business providing genuine products, services and digital tools to motorcycle riders.

MWMX products and services include, but are not limited to:

the MWMX Motocross Coaching App;
coaching and rider-development services;
training programs and educational content;
digital products and services;
membership benefits;
the MWMX Digital Garage;
motorcycle parts, accessories and riding products;
the MWMX Parts Store;
rider programs and benefits; and
other motorcycle-related products and services offered by MWMX from time to time.

The primary purpose of a purchase from MWMX is the acquisition of the applicable product, service, membership, subscription, digital access or other advertised benefit.

Where promotional entries are provided in connection with an eligible MWMX purchase, those entries are provided as an additional and ancillary promotional benefit to the underlying product or service.

MWMX does not sell Promotion entries as standalone products.

The underlying MWMX product or service is provided to the customer regardless of whether the customer wins a Prize.

The opportunity to participate in this Promotion does not increase the advertised price of a qualifying product or service.

No purchase is necessary to participate in this Promotion.

Eligible entrants may also obtain entries through the free-entry methods described in Section 7.

6. PURCHASE-BASED ENTRY METHODS

6.1 Eligible Products and Services

During the Promotion Period, eligible entrants may receive promotional entries in connection with the purchase of qualifying MWMX products or services advertised as participating in the Promotion.

Qualifying products or services may include:

memberships;
subscriptions;
App access;
access packages;
coaching services;
training programs;
digital products;
motorcycle parts and accessories;
Parts Store products; and
other eligible MWMX products or services expressly identified as qualifying during the Promotion Period.

The applicable product or service and the number of promotional entries associated with it will be clearly displayed or communicated to the customer before purchase.

6.2 Entry Allocation

Each qualifying product, service or package may provide a different number of promotional entries.

The applicable number of entries will be displayed at or before the point of purchase.

Entrants may receive multiple entries through eligible purchases where permitted and advertised.

Unless expressly stated otherwise, there is no maximum number of valid purchase-based entries an eligible entrant may hold.

The customer is purchasing the applicable MWMX product or service. Promotion entries are an additional benefit associated with the qualifying transaction.

7. FREE ENTRY METHODS – NO PURCHASE NECESSARY

Eligible entrants may obtain entries into the Promotion without making a purchase by completing one or both of the free qualifying activities described below.

No membership purchase, subscription payment, product purchase or other payment is required to use these free-entry methods.

7.1 Digital Garage – Add a Motorcycle

During the Promotion Period, an eligible entrant may receive:

100 FREE ENTRIES

by creating a valid motorcycle profile in the MWMX Digital Garage.

Creating a qualifying Digital Garage motorcycle profile for the purpose of this Promotion is free.

To qualify:

the motorcycle must be a genuine motorcycle owned by the entrant;
the entrant must provide the information reasonably required to create a valid Digital Garage profile;
information supplied must be genuine and materially accurate;
the profile must be substantially complete;
the profile must be created and successfully recorded by MWMX during the Promotion Period; and
the entrant must otherwise satisfy these Terms.

Limit: one qualifying Digital Garage free-entry allocation per eligible entrant during the Promotion Period.

Accordingly, an eligible entrant may receive a maximum of 100 free entries through this method.

Duplicate, fictitious, fraudulent, misleading or materially incomplete motorcycle profiles will not qualify.

MWMX may request reasonable information to verify that a motorcycle and Digital Garage profile are genuine.

7.2 MWMX App – Submit Riding Footage

During the Promotion Period, an eligible entrant may receive:

100 FREE ENTRIES

by submitting genuine motorcycle riding footage through the designated footage-submission feature of the MWMX App.

Submitting qualifying footage for the purpose of this Promotion is free.

To qualify:

the footage must contain genuine motorcycle riding content;
the entrant must have the legal right to submit the footage;
the footage must satisfy the reasonable technical and content requirements displayed by MWMX;
the footage must not be unlawful or infringe another person's rights;
the footage must not be duplicated or repeatedly submitted solely for the purpose of obtaining additional entries;
the submission must be successfully received and recorded by MWMX during the Promotion Period; and
the entrant must otherwise satisfy these Terms.

Limit: one qualifying footage-submission free-entry allocation per eligible entrant during the Promotion Period.

Accordingly, an eligible entrant may receive a maximum of 5 free entries through this method.

MWMX may reasonably verify the authenticity and validity of a footage submission before allocating entries.

7.3 Using Both Free Entry Methods

Eligible entrants may use both free-entry methods.

An eligible entrant who:

creates one qualifying Digital Garage motorcycle profile; and
submits one qualifying riding-footage submission through the MWMX App

may therefore receive a total of 10 free entries without making a purchase.

7.4 Equal Treatment of Entries

Each valid individual free entry has the same chance of being selected as each other valid individual entry in the draw, regardless of the method through which that entry was obtained.

Free entries have no cash value and cannot be sold, transferred or exchanged.

Completion of a free-entry activity does not guarantee that an entrant will win a Prize.

8. VALIDITY OF PURCHASE-BASED ENTRIES

Where entries arise from a qualifying transaction, those entries become valid once:

payment has been successfully received;
the applicable transaction has been successfully recorded by MWMX; and
all applicable eligibility requirements have been satisfied.

Entries associated with transactions that are fraudulent, unauthorised, reversed, cancelled, refunded, charged back or otherwise invalid may be removed or declared invalid to the extent permitted by law.

Nothing in this section limits any right or remedy available to a customer under the Australian Consumer Law.

MWMX will not refuse a refund, replacement, cancellation or other remedy to which a customer is legally entitled merely because promotional entries were associated with the transaction.

9. ENTRY CONDITIONS

Each individual valid entry has an equal chance of being selected.

Entrants may hold multiple entries through qualifying purchases, free-entry methods or other lawful promotional methods expressly advertised by MWMX.

A greater number of entries provides an entrant with a greater number of chances in the draw but does not guarantee that the entrant will win.

Entries:

have no monetary value;
cannot be sold;
cannot be transferred;
cannot be exchanged for cash; and
are valid only for the Promotion for which they were allocated unless expressly stated otherwise.

Entries must be received and recorded by MWMX before the Promotion closes.

10. ENTRY VERIFICATION AND PROMOTION INTEGRITY

MWMX reserves the right to verify entries and eligibility before or after the draw.

MWMX may invalidate an entry reasonably determined to have resulted from:

fraud;
payment fraud;
chargeback abuse;
manipulation of the Promotion or entry process;
false identities;
materially false or misleading information;
fictitious Digital Garage profiles;
fraudulent or invalid footage submissions;
unauthorised automated entry methods;
exploitation of a technical error;
duplication intended to circumvent an entry limit;
breach of these Terms; or
unlawful conduct.

MWMX will exercise these powers reasonably and subject to applicable law.

11. DRAW METHOD

There will be one winner determined for each advertised Prize.

The draw will be conducted electronically using Randomdraws, or another lawful random electronic draw system permitted under applicable regulatory requirements.

Every valid individual entry included in the draw will have a random and equal chance of being selected.

MWMX will not manually select the winning entry.

Where required by applicable law, draw records and audit information will be retained by MWMX.

MWMX may draw reserve entries where permitted or required to address circumstances in which an originally selected entrant is subsequently determined to be ineligible.

12. WINNER VERIFICATION

Selection in the draw does not by itself establish final entitlement to a Prize.

Before awarding a Prize, MWMX may verify the selected entrant's:

identity;
age;
residential address;
jurisdictional eligibility;
qualifying purchase or activity;
validity of the winning entry;
compliance with these Terms; and
any other information reasonably required to award the Prize lawfully.

If a selected entrant is determined to be ineligible, the Prize will be dealt with in accordance with applicable laws, permit conditions and these Terms.

13. WINNER NOTIFICATION AND PUBLICATION

Each winner will be notified in writing by email and may also be contacted by telephone within 24 hours of the draw, or within any other period required by applicable law.

MWMX will make reasonable efforts to contact each winner using the information associated with the winning entry.

Where required by law, winner information will be published on the MWMX website or another permitted publication such as social media.

Where applicable, winner information will remain published for at least 28 days or such other period required by law.

Entrants are responsible for ensuring the contact information provided to MWMX is accurate and current.

14. PRIZE CLAIM

Prize Claim Deadline: 20th November 2026

A winner must satisfy all reasonable eligibility, verification and prize-transfer requirements before receiving the Prize.

MWMX will make reasonable efforts required by applicable law to contact a winner.

If a Prize remains unclaimed after the applicable claim period, it will be dealt with in accordance with applicable laws and regulatory requirements.

Where legally permitted, an unclaimed Prize may be awarded through a redraw.

15. REDRAW

Where a redraw is required or permitted:

Any redraw will be conducted using a random method consistent with the original draw and applicable regulatory requirements.

Any redraw winner will be notified and published where required by applicable law.

If applicable legislation, a permit condition or a regulatory authority requires a different redraw date, process or approval, that requirement will prevail.

16. MOTORCYCLE PRIZE CONDITIONS

If the Major Prize winner selects the motorcycle, the motorcycle will be supplied substantially as advertised.

The winner must provide all information and documentation reasonably required to transfer or deliver the motorcycles.

Unless expressly advertised otherwise, ongoing costs following transfer or delivery, including registration, insurance, maintenance, licensing and operating costs, are the winner's responsibility.

If a specific motorcycle becomes unavailable for reasons outside MWMX's reasonable control, MWMX may only substitute that Prize where permitted by applicable law and any applicable regulatory requirements.

The winner is responsible for complying with all licensing, registration, safety and other legal requirements applicable to possession or operation of the motorcycles.

17. CASH ALTERNATIVE

If the Major Prize winner selects the cash alternative, payment will be made in Australian dollars by electronic funds transfer following successful verification.

Payment will be made to an Australian bank account held by or otherwise lawfully nominated by the verified winner within 72 hours.

MWMX does not provide taxation, financial or legal advice concerning receipt of a Prize.

18. PARTICIPANT CONDUCT

Entrants must not:

tamper with the Promotion;
manipulate or attempt to manipulate the entry process;
submit false identities;
provide materially false or misleading information;
interfere with MWMX systems;
exploit technical errors;
create fictitious Digital Garage profiles;
submit fraudulent or invalid footage;
repeatedly submit duplicate content to circumvent an entry limit;
use unauthorised automated entry methods;
engage in fraudulent or deceptive conduct; or
otherwise attempt to obtain an unfair advantage.

MWMX may disqualify an entrant or invalidate affected entries where it reasonably determines that a material breach has occurred, subject to applicable law.

19. CHANGES, SUSPENSION OR CANCELLATION

MWMX will not cancel, materially alter, suspend or modify the Promotion after commencement where doing so would breach applicable law or an applicable regulatory condition.

If circumstances outside MWMX's reasonable control materially affect the fairness, security, integrity or lawful operation of the Promotion, MWMX may take such action as is reasonably necessary and legally permitted.

Where regulatory approval is required before changing, suspending or cancelling the Promotion, MWMX will obtain that approval before taking the relevant action.

20. TECHNICAL ISSUES

MWMX is not responsible for an entrant's internet connection, device failure or other circumstances outside MWMX's reasonable control.

MWMX will take reasonable steps to ensure that its own systems used to receive and record entries operate fairly and accurately.

If a technical malfunction materially affects the integrity of the Promotion, MWMX may take reasonable corrective action subject to applicable laws and regulatory requirements.

21. PRIVACY

MWMX may collect personal information for purposes including:

administering the Promotion;
creating and administering entrant accounts;
allocating and verifying entries;
verifying qualifying purchases or activities;
preventing fraud;
contacting entrants and winners;
awarding and delivering Prizes;
administering MWMX products and services; and
complying with legal and regulatory obligations.

Personal information will be handled in accordance with the MWMX Privacy Policy and applicable privacy laws.

Where an entrant separately consents, or where otherwise permitted by law, MWMX may also use personal information for marketing purposes.

An entrant may unsubscribe from marketing communications without invalidating an otherwise valid Promotion entry.

22. SUBMITTED CONTENT

Where an entrant submits motorcycle information, photographs, videos or riding footage through the MWMX platform, the entrant represents that they have the right to provide that material.

Submission of content for the purpose of obtaining free entries does not transfer ownership of that content to MWMX.

Any licence or permission relating to MWMX's use of submitted content will be governed by the applicable MWMX platform terms, privacy policy and any consent obtained from the entrant.

MWMX may remove content that is unlawful, fraudulent, offensive, infringing or otherwise contrary to applicable platform requirements.

23. WINNER PUBLICITY

Where legally required, MWMX may publish a winner's name and other information required by applicable legislation or regulatory authorities.

MWMX may invite a winner to participate in reasonable promotional activities, including photographs, interviews, social-media content or video.

Any additional use of a winner's image, likeness or testimonial will be subject to applicable law and any consent required.

24. LIABILITY AND AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.

Subject to those non-excludable rights and to the maximum extent permitted by law, MWMX is not liable for indirect or consequential loss arising from circumstances outside its reasonable control in connection with the Promotion.

MWMX does not exclude liability where it would be unlawful to do so.

Motorcycles and motorsport activities involve inherent risks and may cause serious injury or death.

A winner who selects the motorcycle Prize is responsible for ensuring that each motorcycle is operated lawfully, safely and by a properly licensed rider where licensing is required.

25. RECORD KEEPING

MWMX will retain Promotion records for the period required by applicable law.

Records may include:

these Terms;
promotional materials;
entry records;
qualifying transaction records;
free-entry records;
Digital Garage qualifying records;
footage-submission qualifying records;
draw records;
winner verification records;
prize distribution records; and
other records required by applicable regulators.

Records will be made available to an authorised regulator where required by law.

26. CONFLICT WITH LAW OR REGULATORY CONDITIONS

These Terms operate subject to all applicable Commonwealth, State and Territory laws and applicable permits, authorities and regulatory conditions.

Nothing in these Terms authorises conduct prohibited by law.

If any provision of these Terms is inconsistent with a mandatory legislative requirement or applicable permit or authority condition, that requirement will prevail to the extent of the inconsistency.

The remaining provisions will continue to operate to the maximum extent permitted by law.

27. SEVERABILITY

If any provision of these Terms is invalid or unenforceable, it will be read down to the extent reasonably necessary where legally possible.

If the provision cannot be read down, it will be severed and the remaining provisions will continue to apply.

28. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia, subject to any mandatory laws applying in an entrant's State or Territory.

The parties submit to the jurisdiction of the courts of Victoria and any other court, tribunal or regulatory body having mandatory jurisdiction over the Promotion.

WEBSITE TERMS & CONDITIONS

1. DEFINITIONS

“MWMX” or “Seller” means MWMX (ACN 687 296 215).

“Customer” means an individual or entity purchasing or using MWMX products or services.

“Products and Services” include goods and services provided by MWMX, including memberships, subscriptions, digital products, the MWMX Motocross Coaching App, training and coaching programs, Digital Garage, motorcycle parts and accessories, Parts Store products and other products or services offered by MWMX.

2. MWMX PRODUCTS AND SERVICES

MWMX provides genuine motorcycle-related products, services and digital tools.

These may include:

MWMX Motocross Coaching App access;
coaching and rider-development services;
training and educational content;
memberships and subscriptions;
digital products;
Digital Garage functionality;
motorcycle parts and accessories;
rider benefits and programs; and
other motorcycle-related products and services.

The nature, duration, features and price of each applicable product or service will be displayed at or before purchase.

Where a product or service includes access for a specified period, that access forms part of the product or service purchased by the Customer.

3. PROMOTIONAL BENEFITS

From time to time, MWMX may conduct trade promotions in connection with its business.

Eligible MWMX products or services may include promotional entries as an ancillary benefit where expressly advertised.

The availability of promotional entries does not alter the underlying nature of the product or service being purchased.

MWMX does not sell Promotion entries as standalone products.

The price of an eligible product or service will not be increased merely because it provides an opportunity to participate in a trade promotion.

Customers receive the underlying product or service regardless of whether they win a Promotion.

MWMX may also provide genuine free-entry methods that do not require a purchase.

Each Promotion is governed by its applicable Promotion Terms or Promotion Schedule, which will specify relevant matters including eligibility, entry methods, entry allocations, Promotion Period, prizes and draw requirements.

4. PAYMENT

All prices displayed by MWMX are in Australian dollars and include GST where applicable.

Accepted payment methods are those displayed at checkout.

Customers authorise MWMX and its payment providers to process the applicable payment for products or services ordered.

MWMX may change its products, services and pricing from time to time, subject to existing contractual obligations and applicable law.

5. SUBSCRIPTIONS

Where a Customer purchases a recurring subscription, the applicable billing frequency and price will be disclosed before purchase.

Recurring subscriptions will automatically renew until cancelled.

Customers may cancel using the cancellation functionality provided by MWMX or by contacting:

Cancellation prevents future renewals but does not retrospectively invalidate products, services or benefits already lawfully supplied, subject to Australian Consumer Law.

6. RETURNS, REFUNDS AND CONSUMER RIGHTS

MWMX products and services come with rights and guarantees that cannot be excluded under the Australian Consumer Law.

MWMX will provide refunds, replacements, cancellations and other remedies where required by law.

Nothing in these Terms excludes or limits a Customer's statutory consumer rights.

Where a transaction associated with Promotion entries is validly refunded, reversed or cancelled, associated promotional entries may be removed where permitted by applicable Promotion Terms and applicable law.

MWMX will not deny a refund or other remedy required by Australian Consumer Law merely because promotional entries were associated with the transaction.

7. DIGITAL PRODUCTS AND ACCESS

Customers purchasing digital access, subscriptions, memberships or App services receive the applicable access and functionality advertised at the time of purchase.

Availability may occasionally be affected by reasonable maintenance, updates, technical failures or circumstances outside MWMX's reasonable control.

Customers must not misuse, interfere with, reverse engineer, manipulate or obtain unauthorised access to MWMX digital systems.

8. DIGITAL GARAGE

MWMX may provide users with Digital Garage functionality allowing motorcycle information, service history, parts information, maintenance information, photographs and other motorcycle-related data to be recorded and managed.

Users are responsible for ensuring information they submit is genuine and that they have the right to upload any content provided.

MWMX may remove fraudulent, unlawful, misleading or infringing content.

9. COACHING AND RIDING CONTENT

MWMX coaching, training and educational material is provided for general motorcycle and rider-development purposes.

Motocross and motorcycle riding are inherently dangerous activities.

Customers and users remain responsible for determining whether any activity is appropriate for their skill level, motorcycle, circumstances and riding environment.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

10. INTELLECTUAL PROPERTY

MWMX owns or licenses intellectual property used in connection with its website, applications, training material, photographs, videos, graphics, branding and digital content.

Customers receive only the rights expressly associated with the applicable product or service.

MWMX content may not be copied, reproduced, commercially exploited or distributed without permission except where permitted by law.

11. USER-SUBMITTED CONTENT

By submitting content through an MWMX feature, users grant MWMX the rights reasonably necessary to store, process and display that content for the operation of the applicable service.

Any use of submitted content for separate advertising or promotional purposes will be subject to applicable law and any additional permission or consent required.

Users must not submit content they do not have the right to provide.

12. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot legally be excluded under Australian Consumer Law or other applicable legislation.

Subject to those rights and to the maximum extent permitted by law, MWMX is not liable for indirect or consequential loss resulting from circumstances outside its reasonable control.

13. SEVERABILITY

If any provision of these Terms is invalid or unenforceable, it will be read down where legally possible.

If it cannot be read down, it will be severed and the remaining provisions will continue to apply.

14. JURISDICTION

These Terms are governed by the laws of Victoria, Australia, subject to mandatory laws applying elsewhere.
